$750,000 compensation awarded to pedestrian hit by a car in a motor vehicle accident

Our client was walking across the road at a set of lights when a car ran a red light and struck her so that she was thrown into the air and struck the windscreen on the vehicle before falling to the ground.

Our client sustained multiple fractures of her leg and ankle which required surgery. She remained in hospital care for several months thereafter and required two further operations on her leg.

Car accident claim lodged within the limitation period

A motor accident claim was brought against the CTP insurer of the vehicle at fault and this was lodged within the six-month limitation period. Liability for the accident was accepted by the insurer.

Our client had been on a disability pension for 15 years prior to the accident. Although no claim was made for economic loss, our client’s injuries were serious enough for her to be awarded over the 11% Whole Person Impairment threshold by the Motor Accident Authority doctors. In addition, she required a significant amount of domestic care for the upkeep of her home and ongoing rehabilitation services and home modifications to her two-storey property.

Doctors reports obtained supporting claims for compensation

After obtaining treating doctors’ reports and medico-legal doctors reports in support of her claims for pain and suffering, ongoing care and need for ongoing treatment expenses, we lodged our client’s application for General Assessment with the Motor Accidents Authority.

The parties were able to convene a settlement conference, and despite there being no claim for economic loss so as to not affect our client’s disability pension, we were able to obtain a resolution of our client’s claim of approximately $750,000.
